Image Licensing Agreement

Agreement
When purchasing images, a binding agreement is established between Ruben Hoogland Media, hereinafter referred to as the Photographer, and the Client. This agreement is intended to clarify the rights for the use of the Photographer’s images by the Client.

Applicability
These terms apply to both images purchased via third-party platforms, such as Pixieset, a web tool used by the Photographer for reviewing and selling image usage rights, as well as images directly shared by the Photographer with the Client via file transfer services such as WeTransfer or Google Drive. When images are shared directly, payment will be made via invoice, referencing this Image Licensing Agreement.

Copyrights
The images remain the property of the Photographer at all times, and the Photographer retains the right to ensure proper use of the images. By purchasing licenses, the Client is granted the right to use these images for their own purposes.

Licensing Fees
The individual license structures are as follows:

  • Non-exclusive owned social media only: €45 per image, per year
    Only for use on owned social media.

  • Non-exclusive owned media: €90 per image, per year
    Usage includes social media, websites, presentations, newsletters, etc.

  • Non-exclusive paid media: €180 per image, per platform, per year
    Usage includes magazines, online publications, social ads, etc.

  • Exclusive usage: €450 per image, per year
    Full rights for commercial use, and this image will be sold exclusively to you.

  • Exclusive unlimited usage: €900 per image
    Full and exclusive rights for limitless commercial use with no restrictions.

Additionally, package prices are offered as follows:

  • Event Package - €360 for 30 images
    Perfect for event recaps! Includes 30 downloadable images for use on social media, blogs, or newsletters. For event-related communication only.

  • Social Media Package - €360 for 10 images per year
    This package includes 10 images for use on owned social media.

  • Owned Media Package - €720 for 10 images per year
    This package includes 10 images for use on social media, websites, presentations, newsletters, etc.

  • Paid Media Package - €1,440 for 10 images per year
    This package includes 10 images for use in magazines, online publications, social ads, etc.

  • Exclusive Usage Package - €3,600 for 10 images per year
    This package includes 10 images with full rights for commercial use, sold exclusively to you.

The above prices are exclusive of VAT.

Wrong Application of Images
If the Photographer suspects that the images are being used in a manner not agreed upon, they are entitled to retroactively charge the correct licensing fees.

Validity of Licenses
Except for images purchased with the “Exclusive unlimited usage” license, the license is valid for one year. It is not possible to license images for shorter terms.

License Renewal
The Photographer uses the calendar year from January 1 to December 31, with January 1 and July 1 as the reference dates. For example, if images were purchased on March 18, 2022, a reminder will be sent on January 1, 2023, asking if the images are still in use. If the images were purchased on August 27, the reminder will follow on July 1 of the following year.

Cancellation of License Extension
The Client may cancel the license renewal in writing via email at any time. If no response is received after the yearly reminder, the Photographer may charge the licensing fees for the new year after 30 days. Of course, for images used on social media or in magazines, these images do not need to be removed, but they may not be reused.

Return Policy
As images and their licenses are digital products and services that have already been provided to the Client, it is not possible to return the images or their licenses after purchase.

Liability
The Photographer is not liable for any claims or disputes the Client may face related to their own use of the images for which a license has been purchased.

Dutch Law
Since the Photographer’s business is based in the Netherlands, Dutch law applies.
